Comunitats de propietaris i prohibici\u00f3 de lloguers tur\u00edstics.<\/h2>\n\n\n\n<p>El Tribunal Suprem, en la seva Sent\u00e8ncia n\u00fam. 1233\/2024, de 3 d&#8217;octubre de 2024, s&#8217;ha pronunciat sobre la possibilitat de les comunitats de propietaris de prohibir l&#8217;activitat de lloguer tur\u00edstic conforme a l&#8217;article 17.12 de la Llei de Propietat Horitzontal (LPH).<br><br>L&#8217;esmentat article 17.12, que va ser afegit a la&nbsp;LPH&nbsp;despr\u00e9s de la seva reforma pel Reial Decret Llei 7\/2019, d&#8217;1 de mar\u00e7, permet a les comunitats adoptar acords per a limitar o condicionar el lloguer tur\u00edstic d&#8217;habitatges, exigint una majoria de tres cinquenes parts del total dels propietaris que, al seu torn, representin les tres cinquenes parts de les quotes de participaci\u00f3. Recordem que, segons la Llei d&#8217;Arrendaments Urbans, es considerar\u00e0 arrendament tur\u00edstic a <em>\u201cla cessi\u00f3 temporal d&#8217;\u00fas de la totalitat d&#8217;un habitatge moblat i equipat en condicions d&#8217;\u00fas immediat, comercialitzada o promocionada en canals d&#8217;oferta tur\u00edstica o per qualsevol altre mode de comercialitzaci\u00f3 o promoci\u00f3, i realitzada amb finalitat lucrativa, quan estigui sotmesa a un r\u00e8gim espec\u00edfic, derivat de la seva normativa sectorial tur\u00edstica\u201d.<\/em><br><br>La controv\u00e8rsia amb l&#8217;article 17.12 t\u00e9 el seu origen en la discussi\u00f3 de si els termes \u201climitar\u201d i \u201ccondicionar\u201d permeten la prohibici\u00f3 total de l&#8217;activitat d&#8217;arrendament tur\u00edstic i si aquesta prohibici\u00f3 suposa una vulneraci\u00f3 del dret a la propietat privada i a la llibertat d&#8217;empresa reconeguts en els articles 33 i 38 de la Constituci\u00f3, respectivament.<\/p>\n\n\n\n<p>En la seva sent\u00e8ncia, el Tribunal Suprem confirma que la interpretaci\u00f3 dels termes &#8220;limitar&#8221; i &#8220;condicionar&#8221; no exclou la possibilitat que la comunitat de propietaris decideixi prohibir completament l&#8217;\u00fas tur\u00edstic. El Tribunal estableix que l&#8217;acci\u00f3 de &#8220;limitar&#8221; pot incloure la prohibici\u00f3 d&#8217;una activitat quan aquesta sigui l&#8217;\u00fanica manera efica\u00e7 de garantir la conviv\u00e8ncia en la comunitat, de manera que permetin conciliar els interessos generals i particulars. En aquest sentit, subratlla que la prohibici\u00f3 d&#8217;aquesta activitat no constitueix una interpretaci\u00f3 extensiva de la norma, sin\u00f3 una aplicaci\u00f3 leg\u00edtima de la capacitat de limitaci\u00f3, esmentant que la voluntat del legislador \u00e9s favorable a l&#8217;arrendament residencial enfront del lloguer tur\u00edstic, la qual cosa fa que la facultat de prohibici\u00f3 sigui conseq\u00fcent amb la intenci\u00f3 del legislador en dictar la norma en q\u00fcesti\u00f3. Respecte als efectes dels acords de la comunitat de propietaris, la sent\u00e8ncia confirma que no tindran efectes retroactius, com ja indicava el propi article 17.12&nbsp;LPH, sobre els immobles en els quals es desenvolup\u00e9s una activitat d&#8217;arrendament tur\u00edstic abans de l&#8217;adopci\u00f3 de l&#8217;acord comunitari tenint validesa \u00fanicament per a situacions futures, assegurant amb aix\u00f2 la protecci\u00f3 dels drets pr\u00e8viament adquirits.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2. Desnonament per precari en el cas d&#8217;adjudicaci\u00f3 de l&#8217;immoble a tercer ali\u00e8 a l&#8217;executant en procediment d&#8217;execuci\u00f3 hipotec\u00e0ria.<\/h2>\n\n\n\n<p>El Tribunal Suprem, en la seva sent\u00e8ncia n\u00fam. 690\/2024, de 20 de maig de 2024, desestima una demanda de desnonament per precari quan l&#8217;adjudicatari d&#8217;un immoble executat en un procediment d&#8217;execuci\u00f3 hipotec\u00e0ria no \u00e9s un tercer ali\u00e8 a l&#8217;executant.<\/p>\n\n\n\n<p>L&#8217;entitat banc\u00e0ria va instar procediment d&#8217;execuci\u00f3 hipotec\u00e0ria en el qual va acabar finalment sol\u00b7licitant l&#8217;adjudicaci\u00f3 de l&#8217;immoble amb la facultat per a cedir la rematada a un tercer.<\/p>\n\n\n\n<p>Aquesta entitat banc\u00e0ria va cedir la rematada a la societat\u00a0AB, cessi\u00f3 que va ser aprovada pel Jutjat a la fi de 2017. Amb posterioritat, aquesta \u00faltima societat va transmetre la titularitat de l&#8217;immoble a una altra mercantil, AB2. Aquesta, posteriorment, va interposar demanda de desnonament per precari contra els ocupants que ja ostentaven la possessi\u00f3 en el primer procediment instat pel banc.<\/p>\n\n\n\n<p>Aquestes tres societats, malgrat tenir distinta personalitat jur\u00eddica, ostentaven una certa connexi\u00f3 quant al capital social d&#8217;aquestes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>L&#8217;immoble hipotecat es va adjudicar a&nbsp;AB&nbsp;el soci \u00fanic del qual era l&#8217;entitat banc\u00e0ria.<\/li>\n\n\n\n<li>AB&nbsp;va passar a denominar-se AB1 que va adoptar nova denominaci\u00f3 com AB2.<\/li>\n\n\n\n<li>La cessi\u00f3 de l&#8217;immoble a AB2, va tenir lloc abans de la venda del 80% del capital d&#8217;AB2 a un fons d&#8217;inversi\u00f3.<\/li>\n<\/ul>\n\n\n\n<p>La controv\u00e8rsia suscitada era si l&#8217;acci\u00f3 de desnonament per part d&#8217;AB2 s&#8217;havia d&#8217;interposar dins del procediment d&#8217;execuci\u00f3 o si, tal com s&#8217;havia realitzat, es podia acudir al judici de desnonament per precari.<\/p>\n\n\n\n<p>El Tribunal Suprem estima el recurs de cassaci\u00f3 declarant que: \u201cQuan l&#8217;adjudicatari d&#8217;un immoble executat en un procediment d&#8217;execuci\u00f3 hipotec\u00e0ria no \u00e9s un tercer ali\u00e8 a l&#8217;executant, no pot acudir al judici de desnonament per precari per a instar el desallotjament de la finca, sin\u00f3 que aquesta pretensi\u00f3 ha d&#8217;exercitar-la en el propi proc\u00e9s d&#8217;execuci\u00f3 hipotec\u00e0ria.\u201d<\/p>\n\n\n\n<p>En conclusi\u00f3, quan l&#8217;adjudicatari d&#8217;un immoble en un procediment d&#8217;execuci\u00f3 hipotec\u00e0ria no \u00e9s un tercer ali\u00e8 a l&#8217;executant, no pot utilitzar el judici de desnonament per precari per a desallotjar la finca, sin\u00f3 que la pretensi\u00f3 ha d&#8217;exercitar-se dins del propi proc\u00e9s d&#8217;execuci\u00f3 hipotec\u00e0ria.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>1.
