La legitimaci\u00f3 activa en assegurances decennals per defectes constructius despr\u00e9s de la venda de l&#8217;habitatge pel promotor.<\/h2>\n\n\n\n<p>En una recent sent\u00e8ncia el Tribunal Suprem s&#8217;ha pronunciat sobre la legitimaci\u00f3 activa per a reclamar a l&#8217;asseguradora una indemnitzaci\u00f3 per defectes constructius coberts per un segur decennal de danys. Segons els antecedents de la sent\u00e8ncia, una promotora que havia estat la prenedora d&#8217;un segur decennal de danys, va construir i va vendre un habitatge unifamiliar (inter\u00e8s assegurat). Posteriorment a la venda la promotora va resultar condemnada a abonar una indemnitzaci\u00f3 al comprador per vicis de l&#8217;edificaci\u00f3 (esquerdes en la fa\u00e7ana). Despr\u00e9s del pagament de la indemnitzaci\u00f3 a aquest, la promotora demanda a l&#8217;entitat asseguradora (que no va ser demandada pel comprador) per l&#8217;import de la indemnitzaci\u00f3 que va haver de satisfer, considerant que conservava la legitimaci\u00f3 activa per a reclamar a l&#8217;asseguradora en haver estat la prenedora del segur decennal.<\/p>\n\n\n\n<p>El Jutjat de Primera inst\u00e0ncia va fallar parcialment a favor de la promotora, determinant que l&#8217;asseguradora havia de pagar una indemnitzaci\u00f3. No obstant aix\u00f2, l&#8217;Audi\u00e8ncia Provincial va considerar que la promotora mancava de legitimaci\u00f3 activa ja que havia venut l&#8217;habitatge i, per tant, no mantenia la consideraci\u00f3 d&#8217;assegurada en la p\u00f2lissa. Davant la decisi\u00f3 de l&#8217;Audi\u00e8ncia, la promotora interposa recurs de cassaci\u00f3.<\/p>\n\n\n\n<p>El Tribunal Suprem en resoldre el recurs, confirma que la condici\u00f3 d&#8217;assegurat en el segur decennal de danys es transfereix al nou propietari de l&#8217;immoble despr\u00e9s de la seva venda, ja que una vegada que la promotora embeni l&#8217;habitatge, perd la legitimaci\u00f3 per a reclamar a l&#8217;asseguradora sobre la base de l&#8217;article 19.2 de la Llei d&#8217;Ordenaci\u00f3 de l&#8217;Edificaci\u00f3 (LOE), que estableix que els successius adquirents de l&#8217;edifici s\u00f3n els assegurats en el segur decennal de danys.<\/p>\n\n\n\n<p>Amb aix\u00f2, el Suprem dictamina en contra de la promotora, subratllant que la legitimaci\u00f3 activa es transfereix autom\u00e0ticament al nou propietari de l&#8217;immoble, sent el nou propietari qui realment sofreix les conseq\u00fc\u00e8ncies de qualsevol defecte estructural i, per tant, qui ha de tenir el dret a reclamar la indemnitzaci\u00f3. En aquest sentit, l&#8217;Alt Tribunal aclareix que el segur decennal de danys \u00e9s una asseguran\u00e7a de danys i no de responsabilitat civil pel que protegeix l&#8217;inter\u00e8s del propietari de l&#8217;habitatge assegurat contra defectes estructurals durant deu anys des de la construcci\u00f3, i no la responsabilitat dels agents de l&#8217;edificaci\u00f3.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2. La legitimaci\u00f3 activa d&#8217;una persona sotmesa a curatela per a interposar demanda de divorci.<\/h2>\n\n\n\n<p>En la seva recent Sent\u00e8ncia de 30 de maig de 2024, el Tribunal Suprem ha abordat la legitimaci\u00f3 per a exercitar una acci\u00f3 de divorci per una persona sotmesa a curatela, concretament si es requereix d&#8217;intervenci\u00f3 del curador i si \u00e9s necess\u00e0ria l&#8217;entrevista amb la persona amb discapacitat, a fi de cerciorar-se de la voluntat manifestada per la representaci\u00f3 legal.<\/p>\n\n\n\n<p>En el cas en q\u00fcesti\u00f3, una persona sotmesa a curatela, exercida per la seva filla, va interposar demanda de divorci sol\u00b7licitant la dissoluci\u00f3 del seu matrimoni, aix\u00ed com altres mesures reguladores de la fi de la parella.<\/p>\n\n\n\n<p>A aquesta demanda es va oposar la llavors esposa al\u00b7legant que (i) en atenci\u00f3 al procediment de modificaci\u00f3 de capacitat del seu esp\u00f2s, aquest no podia interposar demanda de divorci, perqu\u00e8 requeria d&#8217;autoritzaci\u00f3 de la seva curadora per a realitzar \u201cactes jur\u00eddics, econ\u00f2mics i mercantils complexos i per a la supervisi\u00f3 del seu tractament m\u00e8dic i tot el relatiu a la seva salut\u201d, i entenia que la demanda era un acte jur\u00eddic complex; (ii)&nbsp;que el demandant no tenia un convenciment ple i personal sobre l&#8217;exercici de l&#8217;acci\u00f3, aix\u00f2 \u00e9s, que no era capa\u00e7 de comprendre la naturalesa i abast d&#8217;aquesta.<\/p>\n\n\n\n<p>Advertint que el Jutjat de Primera Inst\u00e0ncia i l&#8217;Audi\u00e8ncia Provincial van estimar la demanda interposada per la persona sotmesa a curatela, entenent, fins i tot, que no sols tenia legitimaci\u00f3 activa sin\u00f3 que tenia ple coneixement de l&#8217;acci\u00f3 que estava exercitant, l&#8217;esposa va interposar sengles recursos de cassaci\u00f3 i extraordinari per infracci\u00f3 processal, reiterant les q\u00fcestions oposades en la demanda inicial.<\/p>\n\n\n\n<p>Doncs b\u00e9, l&#8217;Alt Tribunal, desestimant tots dos recursos, ha vingut a confirmar els pronunciaments anteriors, advertint que el demandant tenia legitimaci\u00f3 activa per a interposar la demanda de divorci.<\/p>\n\n\n\n<p>Respecte la suposada necessitat d&#8217;intervenci\u00f3 de la curadora, l&#8217;Alt Tribunal, analitzant la resoluci\u00f3 que va establir la curatela, ha concl\u00f2s que la mateixa no aconsegueix l&#8217;\u00e0mbit personal, m\u00e9s enll\u00e0 de la supervisi\u00f3 dels tractaments m\u00e8dics i de salut. En aquest sentit, els actes jur\u00eddics complexos tenen car\u00e0cter patrimonial, no personal, per la qual cosa quedava exclusivament a la voluntat del demandant l&#8217;instar el divorci,<\/p>\n\n\n\n<p>Quant al convenciment ple i personal de l&#8217;acci\u00f3 que estava exercitant, \u00e9s a dir, l&#8217;al\u00b7legada falta de voluntat del demandant a divorciar-se i a saber qu\u00e8 estava promovent, el Tribunal Suprem conclou que el Jutjat de Primera Inst\u00e0ncia i l&#8217;Audi\u00e8ncia Provincial van desenvolupar una labor adequada i precisa quant a recaptar tots aquells indicis d&#8217;assentiment i voluntat del demandant.<\/p>\n\n\n\n<p>En aquest sentit, i encara que tamb\u00e9 podria haver-se realitzat una entrevista amb la persona amb discapacitat, la veritat \u00e9s que aquesta expressi\u00f3 de la voluntat va ser expressament recollida per declaracions de testimonis, el context en qu\u00e8 es va interposar el procediment i la pr\u00f2pia expressi\u00f3 de voluntat \u2013 via el seu defensa lletrada \u2013 del demandant, no sent necessari confirmar un extrem ja manifestat.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>1.
